1. Introduction

ClassroomEducation (ClassroomEducation.online) is a learning management system and website owned by Zikedish cc, for learners, teachers and home school learners (and parents) that provides learning materials in the form of online courses, videos, online assessments and other relevant materials.

By accessing our website, https://classroomeducation.online (hereafter called: “the/this/our website”, “the/this/our School”, “ClassroomEducation”), you are agreeing to be bound by these Terms & Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials (including, but not limited to videos, PDF’s, PNG’s etc.) contained in this website are protected by applicable copyright and trademark law.

2. Age of Access

This website is for persons 13 years and older. If you are between the ages of 13 and 18, you must have your parent or guardian’s permission to use this website. By using this website, you are telling us by your actions that you have obtained that permission (you are ‘representing’ and ‘warranting’ that you have obtained the appropriate permissions to use our website). Also, see our Privacy Policy in this regard as we take the safety and well-being of our younger students and users very seriously.

3. Limited liability and indemnity

The user uses all content of any communication placed on this website at his/her own risk. In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

This School does not guarantee the truth or correctness of information that appears in any communication of the School or on any of its cyberspaces. Although the School does everything in its power to ensure the quality and accuracy of the services and information, it is the user’s responsibility to verify their truth or correctness.

The School is not liable for any loss, expense or damage of any kind that the user may suffer as a result of his/her access to or use of any information on our website or cyberspaces, including, without limitation, any loss, expenses or damages suffered as a result of any of the following:

  • incorrect information on the website or any communication received from the School or related services;
  • the unavailability of the website or any of its cyberspaces;
  • unauthorized access to or modification of pages on the website or any of its cyberspaces by a third party;
  • the destruction of the user’s data or computer equipment, or the data or computer equipment of a third party that the user used to gain access to the website and any of its cyberspaces;
  • Link or trade with or use the services of an independent service provider or advertiser on the website or any of its cyberspaces or through any communication received from the School.

The user indemnifies the School against any claim, reminder or legal action against the School and/or the School’s owner, Zikedish cc that arises directly or indirectly from the user’s use, participation in or access to the website and/or any of its cyberspaces.

The School reserves the right to change, upgrade or suspend the website and/or any of its cyberspaces and/or its contents at its sole discretion and at any time.

The user is responsible for any content that the user sends to the School, to upload it on the website or any of its cyberspaces or to send to a third party through the School.

The School is not responsible for the loss of content that the user has uploaded or sent to our School or any of its cyberspaces, and it is the user’s own responsibility to make a backup copy themselves.

Notwithstanding the general scope of the foregoing, the user acknowledges and accepts that if he/she places publication, comments, information or any other contribution on the website, cyberspaces or social media spaces, it may result in possible damage as a result of libel by other users of the respective platforms.

Without prejudice to the foregoing, the user further indemnifies the School against any defamation claim that the user may institute against another user of the website or any of its cyberspaces.

4. Revisions and errata

The materials appearing on the School’s website may include technical, factual, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

5. Privacy

The School does not sell, trade, or rent a user and/or Student’s personal identification information to others.

The user gives permission for the School to collect his/her personal information which the user discloses to the School by using the website and/or any of its cyberspaces, or by completing any of the School’s forms, either physically or electronically.

The School may use such personal information as is set out in our Privacy Policy. This Terms & Conditions document should be read in conjunction with our Privacy Policy and Cookie Policy documents, and FAQ page.

6. Copyright

The copyright and all other intellectual property rights of the School and any of its cyberspaces, including the layout, design, logos, badges, graphics, videos and multimedia works belong to the School and its owner.

Without prejudice to the provisions contained in the first paragraph under the Copyright section above, the School confirms that the copyright in contributions, articles and other literary works created by the user and sent to the School belongs to the user.

As soon as the School publishes any of the user’s articles, contributions or other literary works on the website and/or any of its cyberspaces, the user also grants the School a transferable, perpetual, global and royalty-free license for the works for placement on the respective School and/or its cyberspaces.

If the intellectual property of material offered by a user for posting on the website belongs to a third party, the user undertakes to notify the School thereof and indemnifies the School against any claim that the owner of those intellectual property rights have against the School.

The trademarks and logos of the School or related services on any of its cyberspaces are the registered, and where applicable, the unregistered, trademarks of the School or related services. Nothing on the website may be construed to mean that the user obtains a license or the right to use any trademark without the School’s permission.

7. Use License

Permission is granted to temporarily download one copy of any downloadable materials (usually PDF’s or PNG files) from the website for personal, non-commercial transitory viewing only. All videos on this School are however provided as non-downloadable, except for the videos embedded in our Blog posts and Free Resources, which are the only videos which may be downloaded or shared. All other videos, including videos which are part of courses and lessons are provided for personal, non-commercial transitory viewing only, and may only be viewed and/or streamed through this website. This is the grant of the license, not a transfer of title, and under this license you may not:

  1. Modify or copy the materials;
  2. Download or screen-capture any of the videos by any means possible;
  3. Use the materials, including videos for any commercial purpose, or for any public display (commercial or non-commercial);
  4. Attempt to decompile or reverse engineer any software contained on the website and/or any of its cyberspaces;
  5. Remove any copyright or other proprietary notations from any materials or videos; or
  6. Transfer the materials to another person or ‘mirror’ the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and the School may take legal action against you. Upon termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

8. Participation by users

Any user is welcome to comment and participate in a conversation on our website and/or any of its cyberspaces. Comments should be in a civilized tone, free from racism, sexism, homophobia, inappropriate personal remarks, any other form of hate speech or crude, vulgar and dirty language.

Users’ comments are left automatically and unchanged on the respective website or cyberspace as they are rendered. The successful posting of comments may however be subject to an automated screening process based on a predetermined list of unwanted and unacceptable words and phrases.

The deliberate disruption of conversations, including through irrelevant, provocative statements (“trolling” or “flaming”) is not allowed.

Pursuing co-commentators (“stalking”) by constantly focusing on their comments and avoiding meaningful response to those commentators is not allowed.

Repeated posting of the same content in different comment sections or the posting of irrelevant information or links to irrelevant web addresses is not permitted.

Other readers, users and commenters may not be personally attacked and/or humiliated.

Comments must be relevant to the article being commented on.

Comments that incite violence, represent hate speech, include crude or obscene language, or are defamatory or blasphemous in nature will not be tolerated.

If the administrator deems any comment inappropriate for any of the above reasons, or any other reason not explained above, the comment will be removed and the user may be permanently blocked and removed. No reasons or explanations needs to be provided by the administrator to the user.

9. Links

The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user’s own risk.

10. Payment

Payments to our School can be made through PayPal (USD prices only) or Direct Bank Transfer (ZAR prices only), and as per the purchase price as advertised for the specific course or course bundle on the website. We do not store any card details on our website. Once payment is made, the user will become a “Student” and gain access to his/her course or courses from our Courses page and its course directory or his/her My Account page. Payment for products (courses) on our website can be made by a Visa or Mastercard credit or debit card, PayPal or a direct bank transfer. ClassroomEducation and/or its owner are not responsible for any additional fees which may be levied by PayPal and/or the user/student’s bank. Prices are in USD and ZAR. 11. Refunds

If you are not happy for one or another reason, you can cancel your enrollment to a course by informing us in writing within seven (7) days of purchase. We will then refund the money you paid for the course. After seven days, no refunds will be allowed.

12. Academic email support

We endeavour to answer all relevant academic-related questions to guide students to understand the topic better. Email support’s purpose is not to complete the tasks and assignments of your school on your behalf. We are there to support you so you can better understand the work and help you when you are stuck. 13. Modifications

The School may revise these Terms & Conditions for the website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms & Conditions.

14. Governing Law

Any claim relating to this website and/or any of its cyberspaces shall be governed by the laws of the School owner’s, Zikedish cc, home jurisdiction, South Africa without regard to its conflict of law provisions.
